Window Bashing = Pro-Gay Bashing

An interesting criminal justice news story: Someone in Idaho Falls took offense to a bumber sticker on a car that advocated against same-sex marriages. They beat up the car and left a note. I'm not sure what exactly the threating message said. But, I like to think it was something like: "Watch your bumper! If you keep driving around with this message, I'll be back. And, next time, I'll proceed to punch out your headlights. Or, worse, I'll bring a tire iron and break your hub caps."

That's really too bad. It doesn't make any sense to fight intolerance with intolerance. It harms our ability to have a real discussion, for fear of reprisal.

If the offender is caught, will the sentenced be enhanced as a hate crime? It should be. Good for the goose . . .

Idaho does not have a sentencing enhancement for hate crimes. We do have a felony statute for Malicious Harassment. But, that only covers "the specific intent to intimidate or harass another person because of that person's race, color, religion, ancestry, or national origin." Note that sexual orientation is not in the list. This is a straight up misdemeanor crime called Malicious Injury To Property. Maximum possible punishment is 1 year in jail, a $1,000 fine, and payment of restitution.
